Thinking about tearing out those outdated kitchen cabinets? Finally tired of the living room wallpaper? Ready to replace those rotting deck boards?

Before starting on a home improvement project, it’s best to check to make sure a permit isn’t needed.

“In general, the Kentucky Residential Code requires you to obtain a building permit for most renovation projects,” said Emily Martin, spokeswoman for the Louisville Metro Department of Codes and Regulations.

But there are many notable exceptions. Here’s what to know about permits and home renovations in Louisville.

Is it legal to make home renovations without a permit in Louisville?

It depends.

Generally speaking, a building permit is required if there are plans to “construct, enlarge, remodel or change the occupancy of a building as well as erect, install, enlarge, alter, repair, remove, or convert a building,” according to Louisville Metro Government.

Separate permits may be needed, too, for HVAC, electrical, wrecking, or other work.

Still, there are a number of exceptions from needing a permit. They’re not needed for routine maintenance and minor electrical, gas, mechanical, or plumbing repairs, such as replacing light fixtures, stopping minor leaks, or using portable appliances.

“Finish work,” such as painting, carpeting, tiling or installing cabinets and countertops do not require a permit.

Certain small construction projects, such as building accessory structures under 200 square feet, fences under 7 feet tall, retaining walls less than 4 feet high, and small decks that meet specific code criteria, are also exempt from needing a permit.

Sidewalk and driveway projects, too, can be done without a permit.

A full list of allowable projects without a permit can be found in section R105 of Kentucky’s Residential Code, which sets forth standards to ensure public safety, health and welfare in building construction.

Are there penalties for not obtaining a permit?

Yes, if work starts before a permit is issued, you might be subject to penalties described in KRS Chapters 198B, 227, 227A, 234, 236 and 318, according to the state’s building code.

Louisville Metro’s website notes the penalty fee is equal to the standard permit fee and that the minimum penalty for electrical work is $1,000.
